The regular Town Board Meeting
was held Wednesday, May 21, 2008 at 7:00 p.m. in the auditorium of
the Town Hall.
The following people were
present:

A motion was made by Mr. Clark,
seconded by Ms. Major and unanimously carried, the minutes of the
April 16, 2008 Regular Meeting and the May 7, 2008 Special Meeting
and Workshop Meeting be approved as submitted by the Clerk.
A Resolution was offered by Mr.
Thompson, seconded by Ms. Major and unanimously adopted, the
following bills be approved as submitted by the Clerk with the
exception of A Fund Claim #160 to Hahn’s Sales and Service to be
held for further review:

At this time, Mr. Jastrzemski
opened the public hearing on the application of the Frontier
Skydivers for renewal of a Special Permit to operate an Overnight
Camp/Private Club at 3316 Beebe Road, Wilson NY:
Club President was
present and requested that #9 of the Permit, Noise, be changed to
allow members to start flying and jumping at 8:00 a.m. rather than
the 9:30 a.m. requirement in the present permit. He further asked
that #12, Fires, be removed and that they abide by the Niagara
County Open Burning Law. #15, Trailers, calls for removal of all
trailers by November 1st and requested that this
stipulation be removed from the permit.
A resident asked that the
8:00 a.m. start be denied.
All being heard who wished to be
heard, Mr. Jastrzemski closed the public hearing.
At this time, Mr. Jastrzemski
called the public hearing on the application of Focus I, LLD to
rezone property at 3536 New Road, Dorwood Mobile Home Park, Wilson
NY from RR200 to UR100.
Mr. Banks explained that Dorwood
Mobile Home Park is located in a RR200 area and is non-conforming
since Mobile Home Parks are only allowable in UR100 areas.
Because the park has been at this location for so many years, it
is grand fathered in, however, no expansion can be allowed. Focus
I, LLD is asking the Board to change the zoning to UR100 to allow
a 9-acre expansion.
Four residents spoke. All spoke
in opposition to the rezoning.

heard, Mr. Jastrzemski closed the public hearing.
Mr. Jastrzemski called the
public hearing on the application of David S. Erway and Peter N.
Wagner to rezone property at 3256 Lockport Youngstown Road, Wilson
NY, Rainbow Mobile Home Park, from RR200 to UR100.
Mr. Banks explained that Rainbow
Mobile Home Park, like Dorwood Park, is non-conforming and that no
expansion can be considered until the zoning is changed.
Nine people spoke, eight
opposed, one in favor.
All being heard who wished to
be heard, Mr. Jastrzemski closed the public hearing.
There was a brief recess at
this time.
Mr. Jastrzemski reconvened the
meeting and notification was received that Deputy Town Clerk Diane
Muscoreil was awarded a NYS Town Clerks Association Scholarship to
attend the 2008 conference in Saratoga Springs.
An invitation was received form
Gary S. Pettit, Commander Post 836 of the American Legion to
participate in the annual Memorial Day parade and ceremony May 26,
2008.
A request was received from
Wilson Community Enhancement Charity, Inc. for a donation to this
year’s “Summer in Wilson”.
Mr. Jastrzemski opened public
participation.
A Harbor Street resident
spoke.
All being heard who wished to
be heard, Mr. Jastrzemski closed public participation.
Mr. Banks reported 13 building
permits were issued in April with an estimated value of $317,000.
Mr. Andrews reported that the
Town has presented a counterproposal to the union in an effort to
resume labor negotiations. He has also been working on a Local
Law pertaining to yard maintenance and other zoning matters. He
reported that he and Mr. Banks were in Supreme Court today where
the Judge declared properties on Roosevelt Beach and Beebe Road to
be public nuisances.
Mr. Clark reported on the nine
Pennsylvania sportswriters’ visit to Wilson and the success of
this year’s pen rearing project. The fish were released a week
ago and exceeded the expectations of the DEC.
Ms. Major spoke about the need
for a seasonal worker for Greenwood Cemetery.
Mr. Jasatrzemski spoke about
this year’s Pro-Am Tournament and the $10,000 in prizes being
offered for entrants berthed in Wilson Harbor. He spoke about a
grant in the amount of $12,000 through Assemblywoman DelMonte’s
Office for repairs to the boat launch on Riverview Drive and also
the $50,000 grant from Senator Maziarz to update the Town and
Village Master Plan.
A motion was made by Mr.
Jastrzemski, seconded by Mr. Clark and unanimously carried, A
Certificate of Appreciation be presented to Ella Lester for her
work with “Country Roads Caring Neighbors, Inc.” food pantry.
A motion was made by Mr.
Muscoreil, seconded by Mr. Thompson and unanimously carried, a
donation in the amount of $125.00 be made to the Andrea Hope
LaRock Foundation.
A motion was made by Mr.
Jastrzemski, seconded by Ms. Major and unanimously carried, a
public hearing be set for Wednesday, June 18, 2008 at 7:00 p.m. on
the application of Jason Fuller for renewal of a Special Permit to
Operate a Radio Control Car Race Track at 3429 New Road, Wilson
NY.
A Resolution was offered by Mr.
Clark, seconded by Ms. Major and unanimously adopted, approving a
Negative Declaration as to Determination of Significance for a
Type 1 NYS Environmental Quality Review for Rainbow Mobile Home
Park.
A Resolution was offered by Mr.
Muscoreil, seconded by Mr. Thompson and unanimously adopted,
approving a Negative Declaration as to Determination of
Significance for a Type 1 NYS Environmental Quality Review for
Dorwood Mobile Home Park.
A motion was made by Mr.
Muscoreil, seconded by Ms. Major and unanimously carried, the
Skydivers Special Permit be extended until action by the Town
Board on their request for renewal.
The Town Board will audit the
Tax Collector’s book prior to the Town Board Meeting June 18,
2008.
A Resolution was offered by Mr.
Jastrzemski, seconded by Mr. Muscoreil and unanimously adopted,
authorizing a $100 donation to the Salmon Run 5K Race and $100 to
Harbor Hoops.
A Special Meeting was set for
Thursday, May 29, 2008 at 3:00 p.m.
Mr. Jastrzemski noted that
Workshop Meeting will be held at 3:30 p.m. during the months of
June, July and August.
The next Workshop Meeting will
be held Wednesday, June 4 at 3:30 p.m.
The next Regular Meeting will
be held Wednesday, June 18, 2008 at 7:30 p.m.
A motion was made by Ms. Major,
seconded by Mr. Clark and unanimously carried, the meeting be
adjourned at 8:40 p.m.
